Which technical limits and features a specific e-scooter variant must meet for use on public roads in Austria.

What is meant by street legal

When it comes to ordinary e-scooters, we often say they are street legal. What is crucial, however, is whether the specific vehicle falls under the Austrian rules for electrically powered small and mini scooters and is fully equipped.

A shop name, CE marking or visually similar model version does not replace this test. The design, actual configuration, performance, design speed and equipment of the individual vehicle are decisive.

Limits of the e-scooter class

According to oesterreich.gv.at, an e-scooter in this class has a running board, a handlebar and no seat. If the performance or speed limits are exceeded, the vehicle may not simply be used in public transport according to the e-scooter rules.

  • Effective braking device
  • Bell or horn
  • Two white reflectors or reflective foils to the front
  • Two red reflectors or reflective foils to the rear
  • Yellow reflectors or reflective foils to the side
  • Yellow indicators on both ends of the handlebars, acting forward and backward
  • In the dark and poor visibility, white front light and red rear light

Check before purchase or first ride

Model and variant

Product name, nameplate, serial number, software version and ordered configuration must match.

Speed and performance

Have the design speed and maximum permissible performance of the version actually used confirmed in writing.

Equipment

Check the brakes, bell or horn, reflectors, indicators and lighting on the specific vehicle.

Faster or stronger variants

Unlocking, tuning or different software can change the legal classification. Vehicles above the e-scooter limits do not automatically become registrable mopeds; This may require type approval, registration, insurance, license plates, driving licenses and other building regulations.

Do not use an unclear variant on streets with public transport until the classification has been clarified by a responsible authority.
