General Terms and Conditions
Conditions for orders via phscoo.at as well as for agreed service and repair services from Vienna E-Scooter e.U.

1. Contractual partners and scope
To which contracts these conditions apply
These general terms and conditions apply to contracts for goods and services concluded via phscoo.at Vienna E-Scooter e.U., owner Mufeed Karakoshi, Neustiftgasse 113, 1070 Vienna, to be completed. They also apply to workshop and service orders if reference is made to them when the order is placed.
A consumer is a natural person who concludes a legal transaction primarily for private purposes. An entrepreneur is anyone who acts as part of their commercial or self-employed professional activity. Mandatory legal provisions take precedence over these General Terms and Conditions for consumers.
2. Offers and product information
Products, variants and availability
Product representations in the shop are not a binding contract offer, but an invitation to place an order. The variant, equipment, speed, scope of delivery, availability and suitability for the intended use specified in the respective offer are decisive.
Illustrations may differ slightly from the delivered product depending on the screen and batch. Information on range, performance or charging time are comparative or manufacturer values and can be influenced in particular by temperature, payload, driving style, surface, gradients, tire pressure and aging.
3. Order and conclusion of contract
This is how the purchase contract is concluded
- You add products to your shopping cart and check your details in the checkout.
- With the final order button you make a binding offer to purchase the products listed.
- An automatic confirmation of receipt only documents receipt of the order.
- The contract is concluded through our express order confirmation, the availability for collection or the dispatch of the goods.
If an item is not available contrary to the advert, we will inform you immediately. Payments already made for items that cannot be delivered will be refunded. The contract text and the order data are stored within the scope of legal obligations and confirmed by email; Orders can also be viewed in the customer account.
4. Customer account
Access and responsibility
A customer account is set up for purchasing. Access data must be treated confidentially and must not be passed on to unauthorized third parties. Please inform us immediately if misuse is suspected. Information in the customer account must be correct and current.
5. Prices and Payment
Total price and due date
All prices displayed for consumers are total prices in euros including statutory sales tax, unless expressly stated otherwise. Delivery, shipping or other additional costs will be stated before the order is placed.
The specific payment method available is displayed in the checkout. The shop currently offers payment upon pickup. The purchase price is due at the latest when the goods are handed over, unless otherwise agreed in the order confirmation.
6. Delivery and collection
Handover, deadline and danger
Delivery area, delivery time and costs can be found in the offer, checkout or order confirmation. Agreed pick-up dates are only binding after we have confirmed them. For consumers, the risk of accidental loss or damage generally only passes when the goods are handed over to the consumer or a person designated by the consumer.
When you receive packages, check them for visible transport damage and document any abnormalities as soon as possible. Legal rights remain unaffected even if you report later. Further practical information can be found at Delivery and collection.
7. Retention of title
Property until paid in full
The goods remain our property until the purchase price has been paid in full.
8. Right of withdrawal and cancellation
Special rights of consumers
In principle, consumers have a legal right to withdraw from distance selling contracts. The scope, deadlines, exceptions and consequences result from our Cancellation policy. A Sample cancellation form is available, but is not mandatory to use.
There is no general legal right of withdrawal for contracts that are concluded exclusively in the store after a personal inspection.
9. Warranty and Guarantees
Legal rights remain
The statutory warranty provisions apply. A voluntary manufacturer or durability guarantee only exists if it is expressly promised for the product. Such a guarantee does not limit statutory warranty claims against the seller. For details see Guarantee and warranty.
In the event of a complaint, an invoice or order number, model, serial number, a precise description of the error and meaningful photos will help. Safety-critical products should no longer be used until clarification is made.
10. Use and street legality
Check the area of use before setting off
Whether a model can be used on public traffic areas depends on its specific technical design and the regulations applicable at the place of use. Information in the shop does not replace official approval or individual legal advice. Please note the product documentation and our information on Street legal and to the E-scooters in Austria.
11. Workshop, diagnostic and service orders
Release, costs and collection
- A workshop order comes into effect with our acceptance of the specifically described order.
- Testing may require model, serial number, charger, key, app access or accessories.
- Diagnostic flat rates and costs for a cost estimate will be communicated before the order is placed.
- If the diagnosis results in additional work or a noticeable significant change in costs, we will obtain approval before continuing.
- Completion time depends on diagnosis, parts availability and required testing. Dates mentioned are only binding if they have been expressly confirmed.
- After completion we will inform you about collection. Any storage costs will only be charged if they have been announced in advance and collection does not occur despite a reasonable deadline.
Please inform us of any heat, deformation, odor, water ingress or other abnormalities on the battery before handing it over. Suspicious batteries may not be charged or transported without coordination.
12. Liability
Legal liability rules
We are liable in accordance with the legal provisions. In particular, claims against consumers due to personal injury, intent, gross negligence, product liability and mandatory warranty rights are not excluded or limited.

14. Contract language and final provisions
Applicable Law
The contract language is German. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not take away the mandatory protection of the state of their habitual residence. The statutory places of jurisdiction apply to consumers.
Vienna E-Scooter e.U. is currently neither obliged nor willing to participate in dispute resolution before a consumer arbitration body. The former EU online dispute resolution platform was discontinued on 20 July 2025.

The contents of this website provide general information and do not replace individual technical or legal examinations. Product data, availability, prices and scope of services can change and will be confirmed specifically for an order or commission.
The website may only be used within the scope of applicable laws. Automated access, interference with security functions or improper use of contact, account and shop functions are not permitted.
